David Wiley: Police should be able to stop a vehicle for safety reasons (to warn them of equipment failure). Not for the purpose of fines.

David Wiley: It should be truly independent. Part of the auditors office and not any prosecuting office or the attorney general.

David Wiley: This is a priority for my campaign - Qualified immunity is already unconstitutional under our state constitution and needs to be removed. As I have said repeatedly “Nobody should have legal protection to knowingly violate someone’s rights”

David Wiley: I believe the auditor’s office is better suited for non-forensic investigations.

Free Response Questions

  • Public safety is being free from the initiation of violence and prevention of avoidable accidental injury. This is best measured by the number of injuries treated by hospitals.

  • I oppose all victimless crimes and I want to refocus our entire justice system from police, to prosecutors to judges onto crimes with identifiable victims.

My first goal is to introduce banning the unconstitutional practice of Qualified Immunity. The justice system is supposed to keep us safe, but too often is just another abuser. Second I would use the budget to refocus police and prosecutors directly to closing cases.

  • Its not just the police. We need to let leave the door open to corruption of the judicial system at all. This means restoring jury rights in civil cases per our state constitution. This means ending civil asset forfeiture where prosecutors sue property instead of people to seize it. We need to take an aggressive stance against fraud and perjury. Police officers and attorneys caught lying need to be aggressively pursued and fired/lose their license. Our system of justice depends on people being afraid to tell anything other than the truth in court. This shouldn’t just be defendants, it needs to be everyone including police officers, attorneys and even judges and Commissioners.
